Prosper Talent Management Pty Ltd (Prosper, we, us, our) is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Policy explains how we collect, use, disclose and store personal information, and how you can access or correct it. It applies to candidates/creators, clients, contractors and website visitors.

1) What we collect

Personal information we may collect includes:

  • Contact details (name, email, phone, postal address, preferred contact).

  • Professional details (work history, qualifications, portfolio links, social handles such as Instagram/TikTok, rates, availability).

  • Creator/business details (platform links—including OnlyFans or other paid-content platforms—follower metrics, content categories, brand interests, engagement and campaign history).

  • Communications with us (emails/DMs, website form submissions, call notes).

  • Technical data from your device/browser (IP address, user agent, pages viewed, cookies/pixels—see Section 7).

Sensitive information (e.g., health information or criminal history) is collected only with your explicit consent, where reasonably necessary for recruitment, compliance or risk assessment, or where required/authorised by law (APP 3.3).

Government-related identifiers: we do not adopt, use or disclose government identifiers (e.g., Medicare/Tax File Number) except as permitted by APP 9.

Children: our services are intended for individuals 18+. We do not knowingly collect personal information from individuals under 18.

2) How we collect it

We collect personal information:

  • Directly from you (website forms, email/DMs, discovery calls, applications and documents you provide).

  • From third parties with your consent (referees, background-check providers, talent platforms) and from public sources (e.g., LinkedIn, social profiles).

  • Automatically via our website (cookies, pixels and analytics—see Section 7).

We only collect information that is reasonably necessary for our functions or activities (APP 3) and take reasonable steps to notify you about collection and purposes (APP 5).

Unsolicited information (APP 4): if we receive personal information we did not ask for and it is not reasonably necessary for our functions, we will destroy or de-identify it as soon as practicable if lawful and reasonable to do so.

Anonymity/pseudonymity (APP 2): where practicable, you may interact with us anonymously or using a pseudonym (for example, general enquiries), noting it may limit our ability to provide services.

3) Why we use your information

We use personal information to:

  • Assess and match candidates/creators with roles, collaborations or campaigns.

  • Provide talent management and advisory services to clients and creators.

  • Negotiate and administer brand deals, track deliverables and payments, and manage relationships.

  • Communicate with you, respond to enquiries and operate, maintain and improve our website and services.

  • Maintain security, prevent fraud/abuse and comply with legal/regulatory obligations.

  • Conduct analytics and reporting to improve performance and user experience.

We use/disclose information only for the primary purpose of collection or a related purpose you would reasonably expect (APP 6), unless you consent to another use/disclosure or the law permits/requires it.

Direct marketing (APP 7 & Spam Act 2003): we may send updates, insights or offers relevant to creators or clients. You can opt out at any time via the unsubscribe link or by contacting us. Service/transactional messages may still be sent.

4) Disclosing your information

We may disclose personal information to:

  • Clients/brands (with your knowledge/consent) for consideration for roles, campaigns or collaborations.

  • Service providers who support our operations (e.g., website hosting, IT, analytics, background checks, email/CRM, payment tools, professional advisers).

  • Regulators or law enforcement where required or authorised by law.

Overseas disclosures (APP 8): some recipients may be located outside Australia (for example, cloud hosting, analytics or brand partners). We take reasonable steps to ensure overseas recipients handle personal information in a way that complies with the APPs (for example, contractual safeguards). If you are located outside Australia, your information may be transferred to Australia.

5) Data quality and security

Quality (APP 10): we take reasonable steps to ensure personal information we collect, use and disclose is accurate, up to date and complete. Please tell us if your details change.

Security (APP 11): we take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures include role-based access, need-to-know controls, encryption in transit where appropriate, secure storage and staff confidentiality obligations.

Retention & destruction (APP 11.2): we keep personal information only for as long as needed for the purposes set out in this Policy or as required by law. When no longer required, we take reasonable steps to destroy or de-identify it.

Notifiable Data Breaches: if a data breach is likely to result in serious harm, we will assess and notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.

6) Access and correction (APPs 12–13)

You may request access to, or correction of, your personal information. We may ask you to verify your identity. We will respond within a reasonable time and explain any lawful refusal (and how to complain).

7) Cookies, pixels and analytics

We use cookies and similar technologies to operate our website, remember preferences, understand usage and improve performance. This may include analytics services and advertising pixels that collect IP address, device/browser information, pages visited and actions taken.

  • You can manage cookies via your browser settings. Blocking some cookies may affect site functionality.

  • Where a cookie banner is presented, your preferences there will be respected.

Collection via cookies/pixels occurs under APP 3 (collection) and we provide notice under APP 5 (notification). Any use/disclosure is handled in line with APP 6.

8) Creator/UGC platform notes

If you share links to platforms such as OnlyFans or other adult/paid-content services, please avoid sending unnecessary personal details via unencrypted channels. We do not require your platform passwords. Where analytics or revenue data is provided, we treat it as confidential personal/business information under this Policy.

9) Third-party links and social media

Our website and communications may contain links to third-party sites or social platforms. We are not responsible for their privacy practices. We recommend reviewing those privacy policies.

We may update this Policy to reflect changes in law or our practices. The “Last updated” date will change when updates are made. Where appropriate, we may highlight significant changes on our website.
